Terms of Service

Preamble
These Granodiorite Terms of Service (hereinafter referred to as "these Terms") are formulated by the Feniota Team (also known as "Tuxium and Enita", hereinafter referred to as the "Licensor" or "we", "us", or "our") regarding the Granodiorite service operated by it (hereinafter referred to as the "Service"). The Service encompasses all resources, files, and data provided through the domain granodiorite.ferris.love and all of its subdomains (collectively referred to as the "Platform").
Any natural person, legal entity, or other organization (hereinafter collectively referred to as "User" or "you") accessing or using the Service shall be deemed to have fully read, understood, and agreed to be bound by all the provisions of these Terms. If you do not agree to any provision of these Terms, please immediately cease accessing or using the Service.
Article 0. General Information
Granodiorite is a Minecraft: Java Edition game resource mirror distribution service developed and operated by the Licensor. The Service is intended to provide players of Minecraft: Java Edition in regions with inadequate network infrastructure or restricted network access with an efficient and convenient method to download game resources.
Granodiorite itself is free software. You may download its complete source code here to freely inspect, learn from, build, run, and deploy it. Self-deployed instances of Granodiorite are not governed by these Terms; these Terms exclusively regulate your use of the official instance hosted at granodiorite.ferris.love.
Article 1. License for Personal Use
1.1. Subject to your full compliance with all provisions of these Terms, the Licensor hereby grants to the User a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for the purpose of downloading and installing Minecraft: Java Edition.
1.2. When using content related to the Service, the User may promote or quote the Service for any lawful purpose (including, but not limited to, commercial for-profit purposes) without obtaining prior written authorization from the Licensor, provided that proper attribution to the Licensor is attached.
1.3. No person or entity may directly profit through the features provided by the Service in any manner, including but not limited to the integration activities referenced in Article 2, unless prior written authorization has been obtained from the Licensor.
Article 2. Integration and Distribution
2.0. Definitions
2.0.1. For the purposes of these Terms, "Out-of-the-Box" (OOTB) refers to circumstances where a User, in software, libraries, scripts, daemons, or automation tools developed by such User, makes the Service a back-end component automatically invoked by said program without requiring additional configuration by the end user, through any of the following means:
a) Hardcoding the name "Granodiorite", the domain name granodiorite.ferris.love, or the IP address resolved therefrom into source code, configuration files, files automatically downloaded by the program, or binary files;
b) Pre-providing a method to utilize the Service as a back-end within the built-in settings or configuration options of the program;
c) Any other method that invokes the Service without requiring additional configuration by the end user.
2.0.2. For the purposes of these Terms, "Additional End-User Configuration" refers to circumstances where an end user must perform any of the following actions in order to use the Service within specific software:
a) Modifying the program source code;
b) Manually entering a domain name, URL, endpoint, or other address reachable on the Internet leading to the Service, where no information concerning the Service is present in the user interface or built-in help documentation;
c) Searching for and installing additional plugins or add-ons separately;
d) Any other configuration method that does not conform to the out-of-the-box principle.
2.1. General Restrictions
Without the prior written consent of the Licensor, no User shall integrate the Service into any software program or distribution system developed by themselves on an "Out-of-the-Box" basis. Any unauthorized distribution is strictly prohibited.
2.2. Exemptions
2.2.1. If your application simultaneously satisfies all of the following conditions, it shall be exempt from the requirement of "prior written consent" under Section 2.1:
a) The application constitutes Free Software; that is, any user who obtains the application can obtain its source code and enjoys the following four essential freedoms:[1]
- Freedom 0: The freedom to run the program as they wish, for any purpose.
- Freedom 1: The freedom to study how the program works, and change it so it does their computing as they wish. Access to the source code is a precondition for this.
- Freedom 2: The freedom to redistribute copies so they can help others.
- Freedom 3: The freedom to distribute copies of their modified versions to others. By doing this they can give the whole community a chance to benefit from their changes. Access to the source code is a precondition for this.
b) The application must be presented in the form of a Graphical User Interface (GUI) or Command-Line Interface (CLI), and each invocation of the Service must be physically, manually, and instantaneously triggered by a natural person user via a keyboard, mouse, or touchscreen (e.g., clicking a button, or pressing Enter after typing a command).
c) The application must be a standalone end-user product directed at natural persons, namely an Executable program or a manually installed Plugin or Add-on, rather than a Library, Software Development Kit (SDK), Framework, Gateway middleware, or Proxy forwarder. Encapsulating the Service to serve as an upstream component for invocation by other software is prohibited.
d) The application does not generate any financial proceeds for you, except for voluntary personal donations from users that do not carry any condition of feature unlocking. Selling access to unlocked features (such as custom theme colors) or other value-added services under the guise of "donations" or "gratuities" shall not qualify for exemption.
2.2.2. If your application satisfies the exemption conditions set forth in Section 2.2.1, you may integrate Granodiorite-related functionality into such software without obtaining additional written consent from the Licensor, provided that proper attribution to the Licensor is included.
Article 3. Disclaimer of Warranties and Limitation of Liability
3.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
3.2. The Licensor does not warrant that the Service will operate uninterrupted, timely, secure, or error-free, nor does it warrant that any defects will be corrected or that the Service is free of viruses, malicious code, or other harmful components.
3.3. To the maximum extent permitted by applicable law, in no event shall the Licensor (including its affiliates, contributors, and licensors) be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with your access to or use of, or inability to access or use, the Service.
Article 4. Intellectual Property Disclaimer and Acknowledgments
4.1. The Service is not an official Minecraft service and is neither approved by nor associated with Mojang Studios or Microsoft Corporation.
4.2. Minecraft is a registered trademark of Microsoft Corporation. All intellectual property rights in and to the game resources, assets, and files provided through the Service belong exclusively to Mojang Studios (Copyright © Mojang Studios). The Service claims no intellectual property rights over any of the files provided.
Article 5. Copyright and Lawful Use
5.1. All files provided through the Service are copyrighted by Mojang Studios (Copyright © Mojang Studios). The Licensor provides the aforementioned files solely to users who have lawfully purchased a genuine license for Minecraft: Java Edition, in order to improve their resource downloading experience. Users who have not purchased a genuine license for the game are not authorized to use the Service.
5.2. If any rights holder believes that content on the Platform infringes upon its legitimate copyrights or other intellectual property rights, please contact the Licensor promptly. Upon receipt of a valid notice, the Licensor will promptly take reasonable measures to remove or disable access to the allegedly infringing content.
Article 6. Breach and Default
6.1. For any User who breaches these Terms in any manner, the Licensor reserves the right to immediately terminate such User's (and their associated IP addresses or projects') access to the Service without prior notice.
6.2. As specified in Section 1.3 and Section 2.2.1(d), for breaches involving commercial profiting from the Service, the Licensor reserves the right to publicly disclose information including the defaulting party's project name, summary of breach facts, technical details, and other relevant information.
Article 7. Amendments to Terms
7.1 The Licensor reserves the right, at its sole discretion, to modify, supplement, or replace any part or all of these Terms at any time.
7.2 For material changes to these Terms, the Licensor will provide notice by posting an announcement on the Platform.
7.3 Once the revised Terms become effective, your continued access to or use of the Service shall constitute acceptance of and agreement to be bound by the revised Terms. If you do not agree to the revised Terms, you must immediately cease using the Service.
Article 8. Acceptance of Terms
8.1 Any act of obtaining game resources from the Service by a User shall be deemed as acceptance of all provisions of these Terms.
8.2 The Licensor reserves the final right of interpretation of these Terms.
